Privacy Statement

Engage Health Media, LLC (Engage) is a medical communications company that develops and distributes industry-sponsored, medically relevant information to healthcare professionals.

Engage has created this privacy statement to demonstrate our commitment to fully disclosing what information we may collect from you, how we may use the information, and what precautions we take to protect this information.

Engage may ask that you voluntarily provide your personal information to us in order to receive medically relevant, healthcare-related information. We collect this information in a number of different ways including online registration, business reply cards, or through a call center. We may also supplement your data using information from third parties in order to verify the information and maximize the accuracy of our database.

In addition, to measure the success and interest level in specific program offerings, we may track your participation in these programs. Examples of things we measure include whether or not you open an e-mail we send you, whether you click through to view additional information, whether you return a business reply card, or whether you view an online video presentation we send you.

In addition, we collect certain non-personally identifiable information when you visit any Engage Web site. Below, our policies regarding the type of information we collect on our Web sites is summarized.

You may visit any Engage Web site without identifying yourself or revealing any personal information.

We generate log files from each of our Web sites, which include IP addresses, referring site, the time and date you visited, the type of browser you are using, and other standard tracking data Engage uses to evaluate site traffic and usage patterns. Such information is aggregated with tracking data from all site visitors. We will use the information to personalize the site according to user preferences based on the aggregated information. We also use the aggregated information to evaluate products and services we may offer in the future.

Updating Personal Information

You have the opportunity to update and/or modify your personal information at any time and as often as desired by e-mailing Engage at info@biopharmcommunications.com.

Opt Out Option

You have the opportunity to opt out of receiving communications from Engage at any time. To opt out, simply send us an e-mail to info@exper.com. with your name and e-mail address and we will add you to our Do Not Contact List. Additionally, any e-mail you receive from Engage will include instructions on how to be removed from our promotional e-mail list.

California Consumer Privacy Statement

This section applies solely to California consumers. This section provides information about our online and offline privacy practices. This Statement does not apply to our personnel.

This California Consumer Privacy Statement uses certain terms that have the meaning given to them in the California Consumer Privacy Act of 2018 and its implementing regulations (the "CCPA").

  • Inferences: inferences drawn from any of the information identified above to create a profile about you reflecting your preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

We may use the categories of personal information listed above for the purposes described in our Privacy Policy. In addition, we may use these categories of personal information for certain business purposes specified in the CCPA, as described in this table:

As part of our contractual agreements with our Clients, we may provide them or their 3rd party partners with personal information about you and how you interacted with the marketing materials we sent. This would constitute the sale of your personal information, as defined under the CCPA, to our clients and other third parties as described in this Privacy Policy. You have the right to opt out of this disclosure of your information, as detailed below.

During the 12-month period prior to the effective date of this California Consumer Privacy Statement, we may have sold the following categories of personal information:

We do not sell the personal information of minors under 16 years of age without affirmative authorization if we have actual knowledge of the individual’s age.

3.California Consumer Privacy Rights 

You have certain choices regarding our use and disclosure of your personal information, as described below.

Access: You may have the right to request, twice in a 12-month period, that we disclose to you the personal information we have collected, used, disclosed and sold about you during the past 12 months.

Deletion: You have the right to request that we delete certain personal information we have collected from you.

Opt-Out of Sale: You have the right to opt-out of the sale of your personal information.

Shine the Light Request: You also may have the right to request that we provide you with (1) a list of certain categories of personal information we have disclosed to third parties for their direct marketing purposes during the immediately preceding calendar year and (2) the identity of those third parties. 

How to Submit a Request: To exercise the access, deletion and opt-out rights described above, please submit a request to us by either:

Verifying Requests: To help protect your privacy and maintain security, we will take steps to verify your identity before granting you access to your personal information or complying with your request If you request access to or deletion of your personal information, we may require you to provide any of the following information: NPI Number (National Prescriber Identifier), First Name, Middle Name, Last Name, Office Street Address, City, State, Zip Code, Primary Phone Number, and Primary and Secondary Email Address. In addition, if you ask us to provide you with specific pieces of personal information, we will require you to sign a declaration under penalty of perjury that you are the consumer whose personal information is the subject of the request. If you designate an authorized agent to make an access, deletion or opt-out of sale request on your behalf (1) we may require you to provide the authorized agent written permission to do so, and (2) for access and deletion requests, we may require you to verify your own identity directly with us (as described above).

Additional Information: If you choose to exercise any of your rights under the CCPA, you have the right to not receive discriminatory treatment by us. To the extent permitted by applicable law, we may charge a reasonable fee to comply with your request.

Information on Children

Engage does not knowingly collect information from children.

Information Sharing

Engage may share your personal information with the sponsors of our programs so that they can better evaluate the level of interest in these programs. Examples of the type of information we might share include whether or not you open an e-mail we send you, whether you click through to view additional information, whether you return a business reply card, or whether you view an online video presentation we send you.

Additionally, we may also disclose your personal information if it is necessary to: (a) comply with a court order or other legal process; (b) protect our rights or property; or (c) enforce our terms of service.

Aggregated Information

Engage may provide aggregated usage or tracking information collected from our Web sites to third parties.

Engage has implemented physical, technological, and managerial policies to protect the personal information we have under our control from unauthorized access and/or improper use. Only employees who have a job-related need to use the data will be granted access, which will require a correct username and password to authenticate the user.

Engage may also contract with other companies and individuals to assist us with the services we provide. For example, some of our Professional Sites may be hosted on another company’s server, we may utilize technical consultants to help manage our online properties, or we might work with companies to remove duplicate records from customer lists. In order to provide their services, these companies may have limited access to some of the personally identifiable information we maintain. We require all of these companies to comply with the terms of the Engage Privacy Policy, to limit their access to any personal information to the minimum necessary to perform their specific tasks, and not to use the information for any purpose other than fulfilling their responsibilities to us.

Third Party and Affiliated Links

Some Engage Web sites contain external links to other Web sites including medical journals and government-mandated sites. Engage has no control over, and is not responsible for, the content of, or information gathered by, these other Web sites. We do not endorse any of these web sites or the products or services associated with such Web sites merely because they are linked through an Engage Web site.

Notification of Privacy Policy Updates

Engage reserves the right, at any time and without notice, to add to, change, update or modify this privacy policy. If we make a material change to our privacy policy, we will communicate the change to all registered users, either through a prominent notice on our Web sites and/or an e-mail so that you are kept informed of our privacy policy.
